WHAT IS A CONSTRUCTION ACCIDENT CLAIM?

When a site puts you at risk and you get hurt, the law is on your side.

A construction accident claim is a compensation claim brought when you're injured at work because your employer or the principal contractor failed to keep the site reasonably safe. Building sites are some of the most dangerous places to work, which is exactly why duties under the Health and Safety at Work etc. Act 1974, the CDM Regulations 2015 and the Work at Height Regulations 2005 exist to protect you.

If those duties were broken — no edge protection on a scaffold, a poorly maintained machine, no PPE or training — and you got hurt as a result, you may have a strong claim. Not sure what your injury could be worth? Try our personal injury claim calculator for a quick estimate, or read more about your rights after an accident at work.

What you can claim for

Falls from height
Injuries from ladders, scaffolding, roofs or unprotected edges and openings.
Falling objects
Tools, materials or debris dropping onto workers below with no proper guarding.
Machinery & plant
Crush, entanglement or impact injuries from diggers, hoists and power tools.
Electrocution
Shocks and burns from live cables, unsafe wiring or unisolated supply.
Trench & collapse
Crush injuries from unsupported excavations, trenches or structural collapse.
Asbestos exposure
Long-term illness caused by disturbing asbestos without proper protection.

You may have a claim if…

Your injury happened in the last 3 years (longer for under-18s or asbestos illness)
Your employer or the principal contractor failed in their health and safety duties
You're an employed, agency or subcontracted worker on the site
The accident caused a real injury, loss of earnings or other financial harm

Construction accident claim FAQs

Is a construction accident claim really No Win No Fee?+
Yes. We run construction injury claims on a Conditional Fee Agreement, so there's nothing to pay up front and no fee at all if your claim doesn't succeed. If you win, a success fee is deducted from your compensation — capped at 25% of certain damages for personal injury. We'll explain every figure clearly before you sign anything.
How long do I have to make a claim?+
In most cases you have 3 years from the date of the accident to start a construction injury claim in England and Wales. The limit is different for under-18s (3 years from their 18th birthday) and for asbestos-related illness, which usually runs 3 years from the date you knew the illness was linked to your work. It's best to get advice early so vital site evidence isn't lost.
I'm an agency or subcontractor worker — can I still claim?+
Absolutely. You don't have to be a direct, permanent employee to claim. Agency workers, subcontractors and self-employed tradespeople are all owed a duty of care by whoever controlled the site, often the principal contractor. We'll identify exactly who was responsible and pursue the right party for you.
Can I be sacked for making a claim against my employer?+
You're protected by law. Dismissing or disadvantaging you for making a genuine workplace injury claim can be unlawful, and most employers are insured precisely so claims are paid by insurers, not out of their own pocket. If you're treated badly for claiming, tell us — it can strengthen your position.
What if the accident was partly my fault?+
You can often still claim even if you were partly to blame. This is called contributory negligence, and it usually means your compensation is reduced by your share of responsibility rather than refused outright. It's always worth getting it checked — many workers wrongly assume they have no case.
How much compensation could I receive?+
Every case is different, so amounts are illustrative only and a solicitor should review the facts of your claim. Compensation reflects the seriousness of your injury plus losses like missed wages, care, travel and treatment. For a quick guide, try our personal injury claim calculator or call us on 01422 647175.
