How car accident compensation is calculated
Your claim is made up of general damages for your injuries (valued by the Judicial College Guidelines, or the fixed whiplash tariff for minor soft-tissue neck injuries) and special damages for your financial losses — vehicle repairs, hire, lost earnings, treatment and travel.
Since the 2021 reforms, minor whiplash from road-traffic accidents is paid on a fixed tariff. More serious injuries — fractures, psychological harm, life-changing injuries — are valued individually and are usually worth considerably more.
It depends on your injuries and losses. Minor whiplash follows the fixed 2021 tariff (around £240–£4,215), while fractures and more serious injuries are valued individually and can be worth tens of thousands, plus your vehicle and financial losses on top.
Can I claim if I was a passenger?+
Yes. Passengers are almost always entitled to claim, whichever driver was at fault — including a friend or family member, as the claim is met by their insurer.
What if the other driver was uninsured or fled?+
You can still claim through the Motor Insurers’ Bureau (MIB), which compensates victims of uninsured and untraced drivers. We handle MIB claims regularly.
How long do I have to claim?+
Generally three years from the date of the accident. For children, the three years runs from their 18th birthday. Contact us early for the best outcome.
