Debt Recovery Fees & Costs

Fixed fees, hourly rates & No Win No Fee — explained clearly, in writing, before we start

We publish our debt recovery pricing in full, in line with the SRA Transparency Rules, so you always know what the next step costs.

Recovering money owed to your business should not mean uncertainty about legal costs. Whether you need a single letter before action or full litigation and enforcement, we set out our fees clearly and agree them with you in writing before any work begins. The pricing below applies to commercial and business debt recovery in England & Wales.

Debt recovery is one of the areas for which the Solicitors Regulation Authority requires firms to publish price and service information. This page is published in accordance with the SRA Transparency Rules. All figures are exclusive of VAT unless stated; VAT is charged at the prevailing rate (currently 20%).

Option 1

Fixed fee debt recovery

Our fixed fee service is ideal for straightforward debt recovery matters where court proceedings have not yet been issued. Our fixed fee includes:

Initial review of your instructions and supporting documentation.
Legal advice on the merits of your claim.
Drafting and sending a compliant Letter of Claim / Letter Before Action.
Review of one substantive response from the debtor.
Advice on the appropriate next steps.
Claim valueFixed fee (excl. VAT)
Up to £10,000 (Small Claims Track)£150 + VAT
£10,001 – £25,000 (Fast Track)From £350 + VAT
£25,001 – £100,000 (Intermediate Track)From £600 + VAT
Over £100,000 (Multi-Track)Quotation on request

The above fees do not include issuing court proceedings, negotiations, hearings, enforcement action, appeals or counsel’s fees unless expressly agreed. If your matter proceeds beyond the letter before action stage, we will move to the hourly rates below or, where suitable, a No Win No Fee agreement — and we will always agree the basis with you first.

Option 2

Hourly rate charges

Where a fixed fee is not suitable — for example, disputed or complex matters — we charge on a time-spent basis. Our current hourly rates are:

Fee earnerHourly rate (excl. VAT)
Director / Senior Solicitor£295
Solicitor (4+ years’ PQE)£250
Solicitor / Fee Earner£200
Trainee Solicitor / Paralegal£140

The above rates are reviewed periodically and are broadly aligned with the Guideline Hourly Rates published by the courts for England and Wales. They are not fixed by law and may vary depending upon the complexity, urgency and value of the matter. Time is recorded in units of one-tenth of an hour (six-minute units). All work is carried out or supervised by an experienced solicitor.

Option 3

No Win, No Fee debt recovery

For suitable commercial debt recovery matters, we may offer a Conditional Fee Agreement (“No Win, No Fee”), subject to an assessment of the merits and prospects of recovery. Before accepting a matter under a No Win, No Fee agreement we will consider:

The amount of the debt.
The available documentary evidence.
Whether liability is disputed.
The debtor’s financial position.
The prospects of successful recovery.

If your case is accepted:

If your claim is unsuccessful, no legal fees will be payable to us, subject to the terms of the Conditional Fee Agreement.
If your claim succeeds, our legal costs and any agreed success fee will become payable in accordance with the Conditional Fee Agreement.

Important — the risk of the other side’s costs. In litigation, the general rule is that the unsuccessful party pays the successful party’s legal costs. If a defended claim is not successful, you could be responsible for the other side’s costs as well as your own disbursements. We will explain this risk clearly and, where appropriate, discuss whether “After the Event” (ATE) insurance is suitable to protect you.

Disbursements — including court fees, enforcement fees, barristers’ fees, tracing agent fees and expert fees — are payable separately unless expressly agreed otherwise.

Additional costs

Disbursements

Disbursements are costs payable to third parties. They are not included within our legal fees unless specifically stated:

Court issue fees
Barristers’ fees
Process server fees
Enforcement Officer / High Court Enforcement fees
Insolvency search fees
Land Registry fees
Tracing agent fees
Expert fees

Court issue fees are set by HM Courts & Tribunals Service and scale with the value of the claim. As an indication (correct at the time of writing):

Claim value (money claim)Court issue fee
Up to £300£35
£1,000.01 – £1,500£80
£3,000.01 – £5,000£205
£5,000.01 – £10,000£455
£10,000.01 – £200,0005% of the claim value
Over £200,000£10,000

Court fees are set by HMCTS and may change — current fees are published at gov.uk. We will confirm the exact disbursements for your matter before they are incurred and obtain your authority first. Most disbursements do not attract VAT, though some (such as barristers’ and experts’ fees) do — we will make this clear in your estimate.

What happens & how long

Key stages & typical timescales

Every matter is different, and timescales depend heavily on whether the debt is disputed and on the debtor’s conduct. As a general guide:

StageIndicative timescale
Review, advice & Letter Before Action1 – 2 weeks to issue
Debtor’s response period14 – 30 days
Undisputed debt paid after the letterOften 4 – 8 weeks in total
Court proceedings issued (undisputed → judgment)Around 6 – 10 weeks from issue
Defended / disputed claim to trial6 – 12 months, sometimes longer
Enforcement of a judgmentA further few weeks to several months

These are indicative only. We will give you a realistic estimate of the likely timescale for your specific matter, and keep you updated as it progresses.
